Companies│Union Citizens: independent posted worker (more than 90)
WITHIN EUROPE│ MORE THAN 90 DAYS SELF-EMPLOYED TEMPORARY UNION WORKERS
Do you work with a self-employed person from another EU country who stays in Belgium for more than 90 days for an assignment? Then additional obligations apply, both for the self-employed person and for you as the client.
The self-employed person must then:
register with the municipality where he or she resides and apply for a residence card (EU card for Union citizens);
demonstrate that he or she is economically active in Belgium (through an assignment or a contract);
be able to prove sufficient income and housing;
still be able to present a valid A1 certificate;
submit a Limosa declaration.
Duty to Check
You as the client must be aware of the length of stay of the posted self-employed person.
In addition, you must also verify that all administrative obligations are in order, such as:
- Registration with the municipality
- A1 certificate
- Limosa declaration, ...
1. Apply for an EU card
The self-employed posted worker must register with the municipality of residence and apply for an EU residence card. This is an electronic residence card for Union citizens who stay in Belgium for more than three months.
Foreigners Register
The person is then entered into the foreigners register. This allows the posted self-employed to legally reside and work in Belgium.
